The lawsuit by plaintiffs Action4Canada, ten named individuals, three Jane Does and two companies was filed by Rocco Galati of the Center for Constitutional Rights. The complex 391-page lawsuit lays out the biggest hits of conspiracy claims about COVID-19, ranging from vaccine microchips to claims that the pandemic was engineered by the World Health Organization along with Bill Gates and others to install a New World Order. In a ruling this week, about a year after the lawsuit was filed, BC Supreme Court Justice Alan Ross ruled that the notice of civil action is more of a “story” than an actual lawsuit. “It describes wide-ranging global conspiracies that may or may not have affected either the federal or provincial governments. It’s looking for court rulings on issues of science,” Ross said. “Additionally, it includes inappropriate allegations, including criminal behavior and ‘crimes against humanity.’ In my opinion, it is “bad without a doubt”. “It is undeniable that plaintiffs seek to turn this court into an academy of science where a judge will be asked to favor his science over the government’s,” Judge Ross continued. “Alternatively, plaintiffs hope that this court will act as a further legislative body to review, criticize, or overturn the policies of the legislative and executive branches of government. That is not the proper role of this court, except where such actions violate protected Charter rights or exceed the limits of delegated authority.” The notice of civil action, Judge Ross ruled, “is not a proper claim to be answered by the defendants. It cannot be corrected. . . . I have no hesitation in deciding that it should be issued in its entirety.” The decision, however, leaves the door open for the plaintiffs to try again with a coherent lawsuit. Judge Ross ruled that “there is a prospect” that a valid civil claim could be made that certain restrictions based on COVID violate Charter rights. “It will be for the plaintiff to plead these causes of action in accordance with the rules. Such allegations must be framed in a manner that is understandable and allows defendants to know the case they must meet,” Ross ruled. “It must also be limited to matters triable by this court and relief such court may grant.” The suit sought $10 million in general damages and $10 million in punitive damages, which itself violates BC Supreme Court rules. — the request for specific amounts of general damages is not allowed.
